Public rates range from 6% to 10% of rent before minimums and other charges. Foundation Homes has a $300 monthly minimum, while Tamalpais sets different minimums by property type. Placement, annual renewal services and project supervision can materially change the annual bill.

Novato sits in Marin County, which Civil Code section 1947.12 places in the San Francisco-Oakland-Hayward CPI area for the statewide Tenant Protection Act. For a covered home, the statute limits an increase over a 12-month period to 5% plus the applicable cost-of-living change, or 10%, whichever is lower. The statute also lists important exemptions, so a manager needs to identify the property and tenancy before advising on a notice.

That makes the management agreement more than a price sheet. A proposal should identify whether the rate is based on rent collected or scheduled rent, the leasing commission, any monthly minimum, maintenance approval limits, inspection charges, and what happens when the manager takes over an occupied home. Those terms decide the cost an owner actually pays.

Rent increases depend on coverage and timing

For a covered rental, Civil Code section 1947.12 limits increases over any 12-month period to 5% plus the applicable change in the cost of living, or 10%, whichever is lower. The statute identifies Marin County as part of the San Francisco-Oakland-Hayward CPI area and lists exemptions, including certain newer homes and qualifying separately alienable homes when the required notice is provided. Confirm coverage and the effective date before calculating an increase.

Just cause and no-fault terminations

Civil Code section 1946.2 requires just cause after a covered tenant has continuously and lawfully occupied the home for 12 months, subject to statutory exceptions. For a covered no-fault termination, the owner must provide relocation assistance or waive the final month of rent. The assistance or waiver equals one month of the tenant’s rent, and direct assistance is due within 15 calendar days of service of the notice.

Deposits now require records as well as timing

Civil Code section 1950.5 generally caps security at one month’s rent, with a limited small-landlord exception of up to two months. Ask whether the percentage is charged on rent collected or on scheduled rent, and whether a monthly minimum applies. A 7% rate with a $300 monthly minimum is a different arrangement from a 7% rate with no stated minimum.

Ask where the maintenance decision is made. Get the non-emergency approval amount, the after-hours process, the vendor policy, and any project-management charge in writing. Those are the terms that surface after the property is under management, not when the first proposal arrives.
