Late fees and other charges
Senate Bill 267, signed April 8, 2025, rewrote this. The late-fee cap under NMSA 47-8-15(D) fell from ten percent to five, and the base narrowed to rent alone — deposits, utilities and add-on fees no longer count toward it. Raising a fee now takes 60 days' written notice, where raising the rent still takes 30. Screening fees are capped at $50, may be charged only once per applicant in any 90-day period, and must be refunded if no screening happens or the unit is already gone. An undisclosed or unauthorized fee is now treated as an unfair or deceptive trade practice, so a lease built from a stale template is a real liability.
