Understanding Condo Rules and Regulations (2026 Guide)

Understanding Condo Rules and Regulations (2026 Guide)

Condo rules can affect whether you can lease a unit, where your tenant parks, how a move is arranged, and who handles a repair. The useful starting point is the building’s current governing documents, not a list of rules from another association. As the California Attorney General explains, each association’s covenants, conditions, and restrictions (CC&Rs) may be different.

Before buying or renting out a condo, familiarize yourself with those documents and ask about anything that could interfere with the intended tenancy. The checklist below is broadly useful; the legal examples are specifically California examples. This is general information, not legal advice.

Read the declaration, bylaws, and operating rules

Separate the documents by their purpose, but do not assume every state uses identical names or document structures.

  • Declaration or CC&Rs: look for unit and common-area definitions, use restrictions, maintenance allocation, assessments, and enforcement provisions.
  • Bylaws: look for how the association operates, including board roles, elections, meetings, and decision-making procedures.
  • Rules and regulations: request the current board-adopted rules for day-to-day use, together with amendments and fee schedules.

This framework follows the Attorney General’s HOA guidance, which distinguishes CC&Rs, bylaws, and board rules. Ask for the complete current set rather than relying on a seller’s summary. If two documents appear inconsistent, have the association explain its position in writing and obtain legal review where necessary.

Check leasing restrictions before advertising

Ask whether the association requires a lease copy, tenant contact information, a minimum rental term, registration, or approval before occupancy. Find out whether a rental cap or waiting list affects the specific unit. These are questions to investigate, not universal requirements.

For California common interest developments, Civil Code section 4741 limits unreasonable rental restrictions and prohibits restricting rentals to less than 25% of separate interests. It permits governing-document provisions prohibiting transient or short-term rentals of 30 days or less. That does not promise every unit an immediate rental slot or settle every minimum-term dispute.

Ownership dates matter too. Under section 4740, an owner generally is not subject to a governing-document rental prohibition unless it was effective before the owner acquired title. The statute addresses certain protected transfers and requires ownership-date verification and prospective-tenant contact information before leasing under that provision. Section 4741(h) preserves existing rental rights in accordance with section 4740. Ask a California attorney how these provisions and the particular documents interact. For properties elsewhere, check that state’s law before signing a lease.

Plan move-ins, parking, pets, and everyday use

A tenant needs more than the front-door key. Request a practical move packet that answers:

  • Must movers reserve an elevator or loading area? Are there allowed hours or advance booking requirements?
  • Is a move fee charged, or is there a refundable damage deposit? Who pays, and where is the charge authorized?
  • Which parking space belongs to the unit? What are the visitor, permit, and towing procedures?
  • What pet, noise, trash, balcony, and amenity rules apply?
  • How are keys, access devices, and emergency contacts registered?

Use the actual fee schedule. Do not quote a “standard condo move fee” when the amount and conditions belong to that association. Give the tenant the applicable rules before move-in and make the lease’s practical instructions consistent with them.

Association rules still need fair-housing review. The California Civil Rights Department explains that housing providers, including HOAs, must address reasonable disability accommodations. A pet restriction is not a complete answer to an assistance-animal request. Send an accommodation issue through the appropriate review process rather than promising an automatic exception or denial.

Separate common-area and owner maintenance

Draw up a responsibility list for windows, plumbing, roofs, balconies, heating equipment, and interior finishes. Ask where the unit boundary lies and whether an item is an exclusive use common area. A feature used only by one unit is not necessarily that owner’s property for every purpose.

In California, Civil Code section 4775 generally assigns common-area maintenance, repair, and replacement to the association and separate-interest work to the owner, unless the declaration provides otherwise. Its default for exclusive use common area separates owner maintenance from association repair and replacement. The statute also addresses utility interruptions originating in common areas. Read the full provision and declaration for the actual problem.

A responsibility chart helps route a leak report quickly. Include the manager’s emergency contact and the owner’s repair contact. Keep maintenance allocation separate from insurance coverage; ask the insurer to review the master policy and unit policy rather than assuming either pays because the association handles a repair.

Review enforcement before reacting to a violation

Ask for the rule allegedly breached, supporting records, available response process, and current disciplinary schedule. California’s Civil Code section 5855 contains notice, hearing, cure, and decision requirements for member discipline and certain damage charges. Do not assume a warning immediately permits a fine, entry into the unit, or forced sale.

Frequently asked questions

Are all condo associations’ rules the same?

No. The California Attorney General notes that each HOA’s CC&Rs may differ. Request the current declaration, bylaws, board rules, and fee schedule for the building.

Who maintains an exclusive use common area in California?

Under Civil Code section 4775, the default assigns maintenance to the owner and repair and replacement to the association, unless the declaration provides otherwise. Confirm the area’s classification and the declaration.
